Terms of Service

1. Agreement

By accessing or using Alien AI Studio at alieninvasion.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and others who access the Service. You must be at least 13 years old to use Alien AI Studio.

2. Your Account

To use most features, you'll need to create an account. You agree to:

• Provide accurate information when registering
• Keep your password secure and not share it
• Be responsible for all activity that happens on your account
• Notify us immediately of any unauthorized use of your account

One person, one account. You may not create multiple accounts to circumvent free-tier limits or evade a ban.

3. Acceptable Use

When using Alien AI Studio, you agree NOT to generate or share content that:

• Depicts minors in sexual or compromising situations — this is an absolute zero-tolerance rule. Violators will be permanently banned and reported to authorities.
• Impersonates real people in defamatory, fraudulent, or sexually explicit ways. The "Alien Me" feature is for self-transformation only.
• Infringes on someone else's copyright, trademark, or intellectual property
• Promotes violence, terrorism, hate speech, or illegal activity
• Contains graphic violence, gore, or shock content
• Attempts to circumvent our rate limits, credit system, or security measures
• Includes malware, spam, or phishing content
• Is used to train competing AI models in bulk
• Violates the AI provider terms (Google, BytePlus, xAI) we use under the hood

We reserve the right to remove any content and terminate accounts that violate these rules. Severe violations may be reported to law enforcement.

4. Content Ownership

Your prompts and generated content

You retain rights to the prompts you write. The images and videos generated from your prompts are yours to use, share, and even sell, subject to:

• The terms of the underlying AI providers (Google's Imagen, BytePlus, etc.)
• You did not violate Section 3 (Acceptable Use) when generating
• You acknowledge that AI-generated content may not be eligible for traditional copyright protection in some jurisdictions

Public gallery

If you mark a creation as public, you grant Alien AI Studio a worldwide, non-exclusive, royalty-free license to display it in our community gallery, social channels, and marketing material, with attribution if you've set a display name. You can mark any creation private at any time, which removes our public-display rights going forward.

Reference photos (Alien Me)

When you upload a reference photo for the Alien Me feature, you confirm that the photo depicts you or someone who has consented to having their likeness transformed. We do not store reference photos after generation completes.

5. Payments & Subscriptions

Paid plans are processed via PayPal. Subscriptions auto-renew at the end of each billing period (monthly) until you cancel.

• You can cancel any time from your account page or directly via PayPal
• Cancellations take effect at the end of the current billing period
• You retain access to paid features until the end of the period you've already paid for
• Prices are listed in USD and may change with 30 days' notice for new billing cycles

Credits are non-transferable between accounts and reset monthly. Unused free-tier credits do not roll over.

6. Refunds

Because each generation costs us real money to produce (we pay AI providers per request), refunds are limited:

• Within 7 days of subscription: full refund available if you've used 10 or fewer credits
• After 7 days: no refunds, but you can cancel to avoid future charges
• Failed generations: if a generation fails due to a technical error on our end, we'll refund the credits automatically
• Account termination: if we ban you for violating Section 3, no refund is owed

To request a refund, email admin@alieninvasion.ai with your account email and reason.

7. AI Content Disclaimer

You agree that:

• You will not use AI-generated content for fraud, identity theft, or to claim authorship over someone else's likeness
• You will clearly mark AI-generated content as AI-generated when distributing it in journalistic, advertising, or political contexts
• You assume responsibility for how you use the content you create

8. $AI Token Disclaimer

The $AI / NOT ALIEN tokens deployed on Base chain are community memecoins. They are NOT:

• Investment securities or financial instruments
• A guaranteed claim on the platform's revenue
• A substitute for a paid subscription
• Sold or marketed by Alien AI Studio as an investment

Holding $AI tokens may unlock optional discount tiers on our subscription plans, as a community thank-you. Token value can fluctuate to zero. Don't buy tokens you can't afford to lose. Consult a financial advisor before making any token purchases. Cryptocurrency regulations vary by jurisdiction.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may close your account at any time by contacting us.

Upon termination:

• Your access to paid features ends
• Your generations remain accessible to you for 30 days, then are deleted
• Public generations may remain in our community gallery unless you specifically request removal
• Provisions about content ownership, disclaimers, and liability survive termination

10. No Warranty

Alien AI Studio is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure
• AI generations will meet your expectations or be free of defects
• Any specific feature will remain available indefinitely
• Third-party AI providers we depend on will continue operating

11. Limitation of Liability

To the maximum extent allowed by law, Alien AI Studio and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

12. Changes to These Terms

We may update these Terms occasionally. When we do, we'll change the "Last updated" date and, for material changes, notify you by email or in-app notification. Continued use of the Service after a change means you accept the updated Terms.
